Re-use of Public Sector Information

European Communities (Re-use of Public Sector Information) (Amendment) Regulations 2015 (S.I. 525 of 2015)

The European Communities (Re-Use of Public Sector Information (PSI)) Regulations 2005 (as amended by SI 103/2008 and SI 525/2015) create a statutory framework for the re-use by businesses and citizens of existing information held by public sector bodies.  The PSI Regulations provide for the release for re-use of information in a pre-existing format or language, and do not apply to information on which substantial work has to be carried out to prepare it for release for re-use. 

Re-use of Information

TII complies with the PSI Regulations and we encourage the re-use of the information that we produce.  Re-use includes copying, modifying, translating, adapting, distributing or otherwise using the information in any medium, mode or format for any lawful purpose.  This also covers commercial and non-commercial purposes.

PSI Licence

Any information released will be subject to the terms and conditions of the Creative Commons Attribution (CC-BY 4.0) licence. Users must acknowledge TII as the source of the information and the following attribution statement must be used: “Contains Irish Public Sector Information licensed under a Creative Commons Attribution 4.0 International (CC BY 4.0) licence”.

The licence does not grant users any right to use:

  • personal Information, unless sufficiently anonymised and/or aggregated.;
  • third party rights and other intellectual property rights that TII is not authorised to license including, but not limited to, patents, copyright, database rights or trademarks;
  • the names, crests, logos, or other official symbols of TII.

Granting of Exclusive Rights

TII does not authorise any user to have exclusive rights to re-use of its information unless it is deemed by TII to be necessary for the provision of a service in the public interest.

Making a PSI Request

Requests in relation to the PSI Regulations should be made in writing to:

You should clearly indicate that the request is being made under the PSI Regulations.   Every request made in a language other than Irish or English must be accompanied by a translation of the request into Irish or English.  Please be as specific as possible when detailing your request so as to enable the staff of TII to process your application. Also, please include a daytime contact telephone number so that we can contact you should any clarification be required in relation to your request.

In accordance with the provisions of the Regulations, PSI requests are normally responded to within 20 working days of receipt.  Where, due to the extent or complexity of the request, processing will take longer than 20 working days from receipt of the request, TII shall advise you accordingly within three weeks after the initial request was received. In such circumstances, TII will respond in full to the request within 40 working days from receipt of the request. 

Charges

Information provided by TII under the PSI Regulations will normally be free of charge.  However, in exceptional circumstances, for example, if the information requested is not readily available, a marginal cost may be applied to reflect the cost incurred for the reproduction, provision and dissemination of the information. 

Appeal to the Information Commissioner

The PSI Regulations provide a statutory appeals mechanism whereby you may appeal against:

  • a decision of TII to refuse to allow re-use of a document,
  • a decision of TII to refuse to grant an exclusive right to re-use a document,
  • the imposition of a fee for re-use of a document,
  • the amount of a fee imposed, or
  • any conditions to re-use imposed by TII.

Any appeal shall be made within 4 weeks by writing to the Office of the Information Commissioner. The Information Commissioner will fully investigate and consider the matter before issuing a decision. Appeals should be addressed to:
